Legal Terms of Service

These Terms of Service ("Terms") govern your use of Budgetoria — an SMS and
web-based personal budgeting service (the "Service") operated by Loutronics,
doing business as Budgetoria ("Budgetoria," "we," "us"). By creating an
account or using the Service you agree to these Terms.
1. The Service
Budgetoria connects to your financial accounts (read-only, via Plaid),
categorizes your transactions, and communicates budget information to you and
the household members you add — by SMS text message and through a web portal.
If you switch on accountability partners (Section 5), it will also text a
small number of people outside your household. Responses are generated in part
by artificial-intelligence language models.
2. Not financial advice
Budgetoria provides informational summaries of your own spending. It is not a
financial adviser, broker, tax adviser, or fiduciary, and nothing in the
Service constitutes financial, investment, legal, or tax advice.
AI-generated messages may contain errors — verify important figures against
your bank's records before making decisions.
3. Accounts and eligibility
- You must be at least 18 years old to create an account and be the account holder of the linked financial accounts, or have the account holder's permission.
- You are responsible for the accuracy of information you provide and for keeping your login credentials and portal links confidential.
- You may add household members (including minors in your household) to receive and send messages; you are responsible for having their consent, and a parent or guardian's consent for minors.
- You may nominate accountability partners — people outside your household — on the terms in Section 5. They are not our customers and have never agreed to these Terms, so the promises you make about them there are the only thing protecting them.
4. SMS program terms
- By providing your phone number and opting in during signup, you consent to receive recurring automated text messages from Budgetoria (daily digests, alerts, categorization questions, and replies to your messages). Consent is not a condition of purchase of any other product. Full program details: SMS Terms.
- Message frequency varies — typically 1–5 messages/day for household members; accountability partners receive far fewer (see Section 5 and the SMS Terms). Message and data rates may apply and are charged by your carrier.
- Reply STOP at any time to stop receiving messages; reply HELP for help or contact support@budgetoria.com.
- Carriers are not liable for delayed or undelivered messages.
5. Accountability partners
An accountability partner is someone outside your household whom an adult
member nominates to be told when the household goes over a budget category
that member chose to watch. Partners have no account and have not agreed to
these Terms, so when you nominate one you are making promises about somebody
else. Those promises are:
- You have actually asked them. You confirm the person is at least 18, that the number is theirs, that you have a personal relationship with them, and that you have asked them and they have agreed to receive these texts from Budgetoria. Do not add a number from a list, a business or shared line, or a number you are unsure about.
- They decide, not you. We send a nominated number one invitation containing a code and nothing else. They become a partner only if they reply with that code. We never chase a number that does not answer, and we will not send more than three invitations to one.
- "No" is final. If a partner declines, or replies STOP, we stop texting them for your household permanently. You cannot re-add them — removing and re-adding does not reset it, and we will not override it on your behalf. Do not nominate the same person again from another number or another household.
- What they are told. A partner receives the first name of the member who nominated them and the name of the category — never an amount, limit, percentage, merchant, or your household's name. Budgets are household-wide, so a nudge reports that the household went over a watched category, not what any individual spent. Do not use this feature to imply otherwise.
- We can refuse or stop. We may decline to send an invitation, remove a partner, switch the feature off for your household, or suspend your account — at our discretion and without notice — including if a number complains, a carrier flags our traffic, or we have reason to think a partner did not really agree. The feature is offered as-is and may be changed or withdrawn.
- You are responsible for the numbers you add. To the extent the law allows, you will indemnify us against claims arising from a number you nominated without that person's agreement.
6. Bank connections
Bank data is accessed through Plaid Inc. with read-only permissions. We cannot
move money, initiate payments, or change anything at your bank. Your use of
Plaid is subject to the
Plaid End User Privacy Policy.
You may disconnect a bank at any time in the portal or by contacting support.
7. Subscription, trial, and cancellation
- The Service costs $14.99 per month per household after a 14-day free trial. Payment is processed by Stripe; a payment method is collected at signup and charged when the trial ends unless you cancel first.
- You can cancel anytime via the billing portal or by emailing support; cancellation stops future charges and takes effect at the end of the current billing period. Fees already paid are generally non-refundable and partial months are not prorated, subject to the exceptions and goodwill refunds set out in our Refund & Cancellation Policy, and to any rights you have under applicable law.
- Text message packs ($4.99, $9.99, $19.99) are optional one-time purchases, not subscriptions. Credits are applied immediately, never expire, and are non-refundable once credited — again subject to the Refund & Cancellation Policy.
- We may change pricing with at least 30 days' notice; continued use after the notice period constitutes acceptance.
8. Acceptable use
You agree not to misuse the Service — including attempting to access other
households' data, reverse-engineering the Service, sending unlawful content,
or using the Service to violate any law. We may suspend or terminate accounts
that violate these Terms.
9. Data and privacy
Our collection and use of your information is described in the
Privacy Policy. You can request deletion of your
account and data at any time (Section 10 of the Privacy Policy).
10. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY
KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUDGETORIA'S
TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE
AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
BUDGETORIA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES, OR FOR DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY
THE SERVICE.
11. Changes to these Terms
We may update these Terms; material changes will be announced by email, text,
or in the portal at least 14 days before taking effect. Continued use after
the effective date constitutes acceptance.
12. Governing law and contact
These Terms are governed by the laws of the State of Georgia, USA, without
regard to conflict-of-law rules. Questions:
